UPDATE: Trying to get back onto Twitter (other laptop was logged in and none of the others are) so I can tag Lyft and Checkr with this article and the video.. but turns out... I am now also locked out of Twitter. It pretends my username doesn't exist and wont even let me sign on using Google account like I used to. Unrelated but just another example of Elon Musk fucking over Twitter users if they don't share his Nazi worldview. If you can, please tag Lyft and Checkr with links to this as I want to start putting pressure on them to reverse their decision before having to file a lawsuit. But if I do I also want to use Twitter and other platforms to make it into a class action suit as I am sure more people have the sinking suspicion they are also blacklisted.
Lyft is in the process of rejecting my application to drive for them. Everything is great from license to insurance to my new used car which looks great and is very safe.
But they did a background check thru a company called Checkr and they came up with some stuff from my background that is (1) 17 years, (2) 20 years old and... (1) 35 years old (which by the way is listed as a felony when it is actually a class 1 misdemeanor)
Lyft according to their own website only considers DUIs and simple paraphernalia possession charges if they are less than 7 years old.
'Lyft views and assesses your background check results to determine driver eligibility. You may be ineligible to drive on the Lyft platform if your background check results reveal that you:
- Are listed on the National Sex Offender Registry database
- Have been convicted of the following:
- A disqualifying violent crime (such as homicide, kidnapping, human trafficking, arson, burglary, carjacking, robbery, or aggravated assault)
- A sexual offense (such as rape, sexual assault, or child pornography)
- An act of terror
- Driving under the influence of alcohol or drugs in the past seven years (time frame may vary based on the law in your region)
- A disqualifying fraud-related offense in the past seven years (time frame may vary based on the law in your region)
- A disqualifying drug-related offense in the past seven years (time frame may vary based on the law in your region)
- A disqualifying theft or property damage offense in the past seven years (time frame may vary based on the law in your region)
And here is the full disqualifying list provided by Checkr which I have not edited in any way (I don't care about my background it is what it is):
In the 1990 case (35 years ago) I had the verdict expunged which Checkr certainly knows about. The basis for the expungement was the fact that though I was convicted at the time of the felony version of the charge, they changed the law and it was changed to a class 1 misdemeanor.
'Driving as a habitual offender in Virginia is aClass 1 misdemeanor for a first offense, but it can be elevated to a Class 6 felony if the driving endangers life, limb, or property, is part of a DUI, or is a second or subsequent offense. Penalties for a misdemeanor include a mandatory 10-day jail term' Google AI
The change happened 6 months after I got out of jail. My case did not involve life endangerment or a DUI as I was driving my roommate to work at noon on a weekday and got pulled over because the car I was driving, her car, had a tail light out.
This is bullshit. The most recent charge against me predates what they typically consider by 10 fucking years. 10 years.
I don't know what is really behind this, but I going to sue them to find out cus this is bullshit. How many Lyft rides have I taken with a dude who can't speak our language and who seems to barely understand our traffic laws? How many of them have no criminal background to check because... they aren't here legally but they can get a license just fine and apparently they aren't held to the scrutiny that I am... way past their standard cut off limits.
This pisses me off.

note I just sent to Lyft:
' My background check requires assistance from a Lyft Support agent. There are 4 things they found. one is 17 years old, two are twenty years old and one 35 years old and it was expunged. You state things older than 7 years are not considered. I am NOT that person anymore and NONE of them involve fleeing or crashes or violence of any kind. One DUI, one trespassing and one paraphernalia charge. You need to reconsider my application please. The 35 year old charge isn't even a felony anymore, its a misdemeanor for Christ's sake... and it's 35 years old.'
my dispute with Checkr:
'County Searches: The record is inaccurate or has been updated
Explanation: Driving as an habitual offender in the state of Va. is a class 1 misdemeanor not a felony. It was changed 6 months after I got out of jail. My case did not involve a wreck or a DUI. I was driving my roommate to work at noon on a weekday. That is why the record was expunged... and you know it was. Also, you kept me from getting a job working for Lyft when they cut off charges that are 7 years old or more. The habitual offender misdemeanor charge is 35 years old. You need to fix this because I am going to sue both you and Lyft if you don't. Ever heard of Morgan and Morgan? I have.'
This is fucked. In all likelihood they just used these ancient charges as justification to reject me. One felony which isn't a felony anymore and 3 misdemeanors. And I haven't done jack shit in 17 years.
That's some serious bullshit. I want to know from Lyft why they really rejected my application.
