    Israel must not obstruct UN agency’s work: Arab League tells ICJ

    The Arab League said Friday that Israel is legally obligated not to disrupt the operations of the agency for Palestinian refugees (UNRWA).

    It emphasized the UN's permanent responsibility toward the Palestinian cause and the global duty to uphold Palestinian self-determination.

    A statement by Mohamed Helal from the Arab League to the International Court of Justice (ICJ)'s hearing sessions said UN activities in occupied Palestinian territories, including the UN Women and UNICEF programs, are not merely carrying out humanitarian operations but fulfilling the UN’s enduring mandate "to safeguard Palestinian welfare until a just resolution is achieved."

    He added that international aid and diplomatic recognition of Palestine are not "charity" but obligations for countries to take common and separate measures to support self-determination for Palestinians.

    The murder and starvation of populations in real time, subject to rolling coverage and commentary, is not usually the done thing.  These are the sorts of activities kept quiet and secluded in their vicious execution.  In the Gaza Strip, these actions are taking place with a confident, almost brazen assuredness.

    Israel has the means, the weapons and the sheer gumption to do so, and Palestinians in Gaza find themselves with few options for survival.  The strategic objectives of the Jewish state, involving, for instance, the elimination of Hamas, have been shown to be nonsensically irrelevant, given that they are unattainable.  Failed policies of de facto annexation and occupation are re-entering the national security argot.

    Türkiye to make presentation at ICJ on Israel’s crimes against Gaza

    Ankara will make an oral presentation at the International Court of Justice (ICJ) as part of the advisory opinion on determining Israel's obligations towards the United Nations, other international organizations and third states in the occupied Palestinian territories, Parliament's Justice Committee chief Cüneyt Yüksel said on Thursday.

    Yüksel, speaking to Anadolu Agency (AA), reiterated that the ICJ asked for an advisory view on the obligations. Recalling that Türkiye submitted its written opinion to the court in accordance with the second paragraph of Article 66 of the Statute of the ICJ, Yüksel said that 45 member states and international organizations, along with Türkiye, submitted written opinions within this framework prepared in cooperation with the Foreign Ministry and Parliament’s legal team. The written statement underlined that Israel’s attacks against the United Nations Relief and Works Agency for Palestine Refugees (UNRWA) hindered the effective distribution of humanitarian aid to local people. It further added that Israel’s attempt to close the UNRWA is against the U.N. Charter and the 1946 Convention on Privileges and Immunities.

    Cuba files declaration to join S Africa's genocide case against Israel at UN's top court

    The United Nations' top court says Cuba has officially declared its intention to join South Africa’s case against Israel at the tribunal over the regime's genocide against Palestinians in the Gaza Strip. 

    In a statement released on Monday, the International Court of Justice (ICJ) announced that Cuba had filed a declaration of intervention in the proceedings against Israel for Genocide Convention violations under Article 63 of the Statute of The Hague-based court.

    “Cuba, invoking Article 63 of the Statute of the Court, filed in the Registry of the Court a declaration of intervention in the case concerning Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip,” it said...

    South Africa vs Israel: 14 other countries intend to join the ICJ Israeli Genocide case

    Fourteen countries have announced their intention to intervene in the context of South Africa’s complaint, which accuses Israel of “genocide” in the Gaza Strip, before the International Court of Justice (ICJ).

    The interveners do not formally join a party or a complaint, but simply present their position on the law (and, in some cases, the facts) without formally taking sides.

    The latest to do so is Bolivia on 9 October, following Chile and Maldives. Spain has been in June the third European country to make this announcement after Belgium and Ireland. South Africa filed its complaint on 29 December, 2023, with the ICJ, the United Nations court responsible for resolving disputes between states. Pretoria accuses Israel of violating the Convention on the Prevention and Punishment of the Crime of Genocide in its military assault on Gaza.

    The offensive has destroyed large parts of the Palestinian enclave, killed more than 43,000 civilians, and led to massive population displacements. The lack of access to international humanitarian aid is also causing famine to threaten Gaza, according to UN reports. On 24 May, the Court ordered Israel to “immediately cease its military offensive” in the city of Rafah, in southern Gaza. So far, Israel has not complied with this decision...

    South Africa submits 750 pages of evidence in genocide case against Israel

    South Africa's legal team on 28 October submitted hundreds of documents to the International Court of Justice (ICJ) offering "undeniable evidence" of acts of genocide committed in Gaza by the Israeli army and statements by authorities that carry genocidal intent.

    "The evidence will show that undergirding Israel’s genocidal acts is the special intent to commit genocide, a failure by Israel to prevent incitement to genocide, to prevent genocide itself, and its failure to punish those inciting and committing acts of genocide," a statement from Pretoria says.

    "South Africa’s Memorial is a reminder to the global community to remember the people of Palestine, to stand in solidarity with them, and to stop the catastrophe. The devastation and suffering has been possible only because despite the ICJ and numerous UN bodies’ actions and interventions, Israel has failed to comply with its international obligations,” the statement added.

    Officials say that the submission, also called a memorial, is presented in more than 750 pages of text, in addition to over 4,000 pages of annexes.

    Speaking to Al Jazeera, officials said they are confident that the hundreds of pages of evidence are “more than enough” to sustain their case. “The problem we have is that we have too much evidence,” Ambassador Vusimuzi Madonsela, South Africa’s representative to The Hague, told the Qatari news organization.

    Some of the evidence submitted includes public statements made last week by senior members of the Israeli government at a conference named "Preparing to Settle in Gaza," which was organized by the extremist Nachala Settlement Movement and promoted by Israel's ruling Likud party...

    South Africa to submit evidence against Israel at UN court

    South Africa says it plans to file a memorial with the International Court of Justice (ICJ) next month to provide evidence that Israel is committing genocide against Palestinians in its conflict with Hamas in Gaza.

    President Cyril Ramaphosa’s office announced the move on Tuesday, vowing that a lawsuit it initiated against the Israeli government late last year will continue until the top court issues its ruling.

    Africa’s most advanced economy filed a case with The Hague-based ICJ back in December, alleging that Israel’s offensive in Gaza following a surprise attack by Hamas on the Jewish state more than 11 months ago is “genocidal in character.” Israel declared war on Hamas following a series of raids by the Gaza-based militant group last October 7, which resulted in the deaths of 1,200 Israelis. Since then, Israeli military operations have resulted in nearly 41,000 Palestinian deaths and 95,000 injuries, turning much of Gaza into rubble and rendering it uninhabitable...

    ICJ ruling recognizes the colonial nature of Zionist entity

    The International Court of Justice (ICJ), one of the six organs of the United Nations, has declared that Israel's presence in the occupied Palestinian territories is illegal and must end "as soon as possible."

    On Friday, ICJ President Nawaf Salam presented the non-binding advisory opinion of a panel of 15 judges regarding the Israeli occupation of Palestine, which was covered widely by the media.

    The advisory opinion details a series of Israeli policies that, according to the court, violate international law. These include the construction and expansion of settlements in the occupied West Bank and East Jerusalem, the exploitation of natural resources, the annexation and prolonged control of lands, and discriminatory practices against Palestinians.

    The top UN court concluded that Israel has no right to exercise sovereignty over these territories, emphasizing that the entity is violating international laws that prohibit the acquisition of land by force and obstructing the Palestinians' right to self-determination.

    "The construction of Israeli settlements in the West Bank and East Jerusalem, as well as the regime associated with them, has been established and maintained in violation of international law," it stated...

    Türkiye assigns international crew for genocide case against Israel

    Türkiye is pressing ahead with the case against Israel at the International Court of Justice (ICJ) it sought to be a party of. The government moved to form a crew of local and international jurists specifically for the case, Sabah newspaper reported.

    Foreign Minister Hakan Fidan announced last month that Ankara had decided to join the ICJ genocide trial. “This is a process with myriad legal details and not an ordinary case. Therefore, our experts concentrated their efforts on it. We will present legal documents and carry out the process with local and international lawyers,” he stated recently.

    Türkiye’s crew will include academics specialized in law and lawyers. The list of Turkish academics and jurists is largely determined. Türkiye is now selecting international experts on such international cases, especially against Israel. Authorities say crew selection and preparation of a formal document for application may take months. Türkiye first has to decide the legal framework of its application, to avoid having something that may be turned against Türkiye in the future. Turkish citizens have faced genocide allegations in the past by the Armenian lobby.

    Israel’s war on Gaza live news: Rafah carnage prompts global condemnation

    • Israeli forces have bombed a tent camp housing displaced people in a designated safe zone in Rafah, killing 45 Palestinians, most of them women and children. The attack has triggered an international outcry, leading to calls for a ceasefire.
    • The attack on the camp in Tal as-Sultan came after Israeli forces bombed shelters housing displaced Palestinians in other areas including Jabalia, Nuseirat and Gaza City, killing at least 160 others, according to Palestinian officials.
    • Israel’s top military prosecutor described the Rafah attack as “very grave” and said an investigation is under way. Earlier, the Israeli military confirmed the attack, saying it targeted Hamas fighters.

    'Children burned alive': Death toll from Israel attack on Rafah safe zone rises to 50

    The death toll from the Israeli regime’s airstrikes against a designated safe zone for displaced people in the city of Rafah in the southern Gaza Strip has risen to at least 50 people.

    ActionAid UK, the British chapter of an international relief organization, reported the fatalities on Sunday.

    Earlier in the day, Israeli warplanes fired eight missiles toward makeshift shelters housing internally-displaced persons in the city’s northwest.

    “These shelters were supposed to be safe havens for innocent civilians, yet they became targets of brutal violence,” the organization said.

    “Children, women, and men are being burned alive under their tents and shelters,” it noted, warning that the number of fatalities could rise.

    Reacting to the massacre, the Palestinian resistance movement Hamas called it an “egregious affront” to a recent ruling by the International Court of Justice, which ordered the Israeli regime to “immediately” halt its offensive against Rafah...

    Erdoğan leads global condemnation of Israel's Rafah massacre

    Turkish President Recep Tayyip Erdoğan led Monday a global condemnation of the Israeli massacre of displaced Palestinians at a Rafah "safe zone."

    He said the massacre of at least 45 people, mostly women and children, once again exposed the true face of "terrorist state" Israel.

    "Sunday's attack on Rafah, which came after the International Court of Justice's order, has exposed the treacherous and bloody nature of the terror state," he said in a televised address.

    The Turkish president also lashed out at Israeli Prime Minister Benjamin Netanyahu, saying: "The embattled Netanyahu and his murderous network are trying to extend their grip on power by massacring people as they fail to defeat Palestinian resistance."

    "Netanyahu won't be able to save himself ... like (former Yugoslav strongman Slobodan) Milosevic, (genocide convict Bosnian Serb politician Radovan) Karadzic, and (late German dictator Adolf) Hitler, who he is imitating," he added.

    Erdoğan also vowed that Türkiye would do everything in its power to hold those "savages" to account...

    Israeli bombing of Rafah 'safe zone' kills at least 45 Palestinians

    At least 45 Palestinians, mostly displaced women and children, were killed Sunday when a barbaric Israeli bombardment targeted a Rafah tent camp for displaced people.

    The Gazan Health Ministry said in a statement that the strikes "claimed the lives of 45 martyrs and left dozens injured, most of them children and women," while the Israeli army claimed it had targeted Hamas members.

    The media office in Gaza earlier said the attack hit a center run by the U.N. agency for Palestinian refugees in Tal al-Sultan near Rafah, branding it a "horrific massacre."

    Israeli aircraft targeted several tents in the area, the media office said, adding that missiles and 2,000-pound bombs were used.

    Earlier, Gaza's civil defense force said it transported 50 people, including dead and injured, after the bombing. The targeted area sheltered at least 100,000 displaced people, it said.

    The Palestine Red Crescent Society in a brief statement said its ambulance crews were moving the victims to nearby medical centers.

    The attack led to fires engulfing the area some of which are still raging, according to witnesses.

    "We retrieved a large number of child martyrs from the Israeli bombardment, including a child without a head and children whose bodies have turned into fragments," a Palestinian paramedic told Anadolu...

    UN expert: ‘Very little hope’ of Israel abiding by ICJ order to stop Rafah invasion

    As if Israel’s legal and diplomatic woes weren’t dire enough, this afternoon in The Hague, the International Court of Justice ordered it to suspend its military operations in Rafah, to open the Rafah crossing to humanitarian aid, and to allow international observers into Gaza to ensure that evidence of Israeli genocide is not destroyed.

    Today’s landmark ICJ “provisional measures” order is the Court’s response to South Africa’s May 10 application. 

    The situation in Gaza — and in Rafah particularly — couldn’t be more urgent, South Africa told the top UN court in its application, triggering two days of hearings. South Africa presented on Thursday, May 16. 

    “The onslaught on the Palestinians in Gaza is of a nature that can only be intended to result in the genocidal destruction of that group,” South Africa’s application stated. “In attacking Rafah, Israel is attacking the ‘last refuge’ in Gaza, and the only remaining area of the Strip which has not yet been substantially destroyed by Israel. With Rafah’s destruction, the destruction of Gaza itself will be complete.”

    N. Gaza sees heavy clashes as Israel ventures further into Rafah

    Israeli forces intensified military strikes on Gaza on Friday, with heavy fighting reported in Jabalia in the north and tanks advancing further into Rafah in the south, according to residents and medics.

    Medics said at least five Palestinians were killed when houses were hit in Jabalia and more were believed to be trapped under rubble, but that the area could not be reached due to the intensity of the bombardment.

    In the southern city of Rafah bordering Egypt, where an escalating Israeli assault has sent hundreds of thousands of people fleeing from what was one of the few remaining places of refuge, residents reported explosions and smoke rising in the distance as tanks advanced further into the east.

    Judges at the U.N.'s top court were due to rule later in the day on South Africa's request to order Israel to halt its Rafah offensive and withdraw from Gaza, in part of a wider case accusing Israel of genocide...

    Israeli warplanes bomb Gaza after top UN court orders halt to invasion

    Israel has bombed the Gaza Strip, including Rafah, despite an order from the UN's top court for it to "immediately halt" its military invasion of the southern city.

    Israeli warplanes targeted parts of Rafah and the central city of Deir al-Balah early Saturday, just a day after the Hague-based International Court of Justice ordered Israel to swiftly stop its military aggression against war-hit Rafah.

    “We hope that the court’s decision will put pressure on Israel to end this war of extermination because there is nothing left here,” said a Palestinian woman from Gaza City displaced to Deir al-Balah by the war.

    The strikes on Saturday, however, proved that Israel gave no indication it was preparing to change course in Rafah. 

    "Israel is an entity that considers itself above the law. Therefore, I do not believe that the shooting or the war will stop other than by force," Mohammed Saleh, another Gaza City resident, told AFP. ..
