(a) Basic Offense.—Whoever, whether in time of peace or in time of war and with the specific intent to destroy, in whole or in substantial part, a national, ethnic, racial, or religious group as such—

    (1) kills members of that group;
    (2) causes serious bodily injury to members of that group;
    (3) causes the permanent impairment of the mental faculties of members of the group through drugs,         torture, or similar techniques;
    (4) subjects the group to conditions of life that are intended to cause the physical destruction of             the group in whole or in part;
    (5) imposes measures intended to prevent births within the group; or
    (6) transfers by force children of the group to another group;
        shall be punished as provided in subsection (b).
 
(b) Punishment for Basic Offense.—The punishment for an offense under subsection (a) is—
    (1) in the case of an offense under subsection (a)(1), where death results, by death or                             imprisonment for life and a fine of not more than $1,000,000, or both; and
    (2) a fine of not more than $1,000,000 or imprisonment for not more than twenty years, or both, in             any other case.
 
(c) Incitement Offense.— Whoever directly and publicly incites another to violate subsection (a) shall be fined not more than $500,000 or imprisoned not more than five years, or both.
 
(d) Attempt and Conspiracy.— Any person who attempts or conspires to commit an offense under this section shall be punished in the same manner as a person who completes the offense.
 
(e) Jurisdiction.—There is jurisdiction over the offenses described in subsections (a), (c), and (d) if—
    (1) the offense is committed in whole or in part within the United States; or
    (2) regardless of where the offense is committed, the alleged offender is—
            (A) a national of the United States (as that term is defined in section 101 of the Immigration and Nationality Act (8 U.S.C. 1101));
            (B) an alien lawfully admitted for permanent residence in the United States (as that term is defined                     in section 101 of the Immigration and Nationality Act (8 U.S.C. 1101));
            (C) a stateless person whose habitual residence is in the United States; or
            (D) present in the United States.

Benjamin Netanyahu (or Benzion Mileikowsky his real name) has been a U.S. citizen TWICE during his life (56-58 and '63-'68) which he relinquished to serve as Prime Minister in Israel. Would he qualify for violation of US Code 18/1091? I do not know. However, several U.S. figures possibly including the current president and Sec. of Defense and others might qualify as persons who conspire to commit acts of genocide considering the fact that they sent military advisors over to Israel early in this process to help the IDF plan and then carry out this campaign of genocide against the people of Palestine in Gaza.
 
This is why I believe that the State Department 'unequivocally' refuses to admit Israel is committing genocide in Gaza. Because if they do... they themselves may very well be convicted of this crime. The punishment for such offenses is death or life in prison as death has certainly occurred in Gaza as a result of Netanyahu's genocidal campaign.

Israel's warfare in Gaza is consistent with the characteristics of genocide, a special U.N. committee said Thursday, accusing the country of "using starvation as a method of war."

Israel's warfare practices in Gaza "are consistent with the characteristics of genocide," the U.N. Special Committee to Investigate Israeli practices said in a newly released report, pointing to the "mass civilian casualties and life-threatening conditions intentionally imposed on Palestinians there."

"Since the beginning of the war, Israeli officials have publicly supported policies that strip Palestinians of the very necessities required to sustain life – food, water and fuel," the committee said, adding that Israel has systematically interfered with humanitarian aid to use vital supplies for political and military ends.

Covering the period from October 2023 (when the Gaza offensive began) to July 2024, the report highlighted the devastating impact of Israel’s ongoing siege and bombing campaigns. It underscored how the destruction of Gaza’s infrastructure, including water, sanitation and food systems, has led to a humanitarian disaster.

"By destroying vital water, sanitation, and food systems and contaminating the environment, Israel has created a lethal mix of crises that will inflict severe harm on generations to come," the committee warned...

Definition of Genocide and Israel Found to be Committing Genocide in Gaza

The Convention on the Prevention and Punishment of the Crime of Genocide (CPPCG), or the Genocide Convention, is an international treaty that criminalizes genocide and obligates state parties to pursue the enforcement of its prohibition.

Article 2 of the Convention defines genocide as:

'Genocide, as the denial of the right of a people to exist and the subsequent attempt or success in annihilating them, entails various modes of elimination. Raphael Lemkin, who coined the term “genocide”, observed that genocide is “a composite of different acts of persecution or destruction”, ranging from physical elimination to the “forced disintegration” of a people’s political and social institutions, culture, language, national sentiments and religion. CONCLUSIONS 

93. The overwhelming nature and scale of Israel's assault on Gaza and the destructive conditions of life it has inflicted reveal an intent to physically destroy Palestinians as a group. This report finds that there are reasonable grounds to believe that the threshold indicating the commission of the following acts of genocide against Palestinians in Gaza has been met: killing members of the group; causing serious bodily or mental harm to groups’ members; and deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part. Genocidal acts were approved and given effect following statements of genocidal intent issued by senior military and government officials.


94. Israel has sought to conceal its eliminationist conduct of hostilities sanctioning the commission of international crimes as IHL-abiding. Distorting IHL customary rules, including distinction, proportionality and precautions, Israel has de facto treated an entire protected group and its life-sustaining infrastructure as ‘terrorist’ or ‘terrorist-supporting’, thus transforming everything and everyone into either a target or collateral damage, hence killable or destroyable. In this way, no Palestinian in Gaza is safe by definition. This has had devastating, intentional effects, costing the lives of tens of thousands of Palestinians, destroying the fabric of life in Gaza and causing irreparable harm to its entire population.


95. Israel’s genocide on the Palestinians in Gaza is an escalatory stage of a long-standing settler colonial process of erasure. For over seven decades this process has suffocated the Palestinian people as a group – demographically, culturally, economically and politically –, seeking to displace it and expropriate and control its land and resources. The ongoing Nakba must be stopped and remedied once and for all. This is an imperative owed to the victims of this highly preventable tragedy, and to future generations in that land.
