The U.S. Supreme Court has further eroded the power of the Environmental Protection Agency and state governments to safeguard water quality under the Clean Water Act. In Tuesday’s 5-4 ruling, the majority overturned measures limiting the discharge of wastewater into harbors and coastal areas, including limits on the release of raw sewage. This comes less than two years after the Supreme Court gutted Clean Water Act protections for about half of all wetlands in the contiguous United States.

The Supreme Court voted 5-4 against the Trump administration’s effort to freeze foreign aid

The Supreme Court on Wednesday rejected President Trump’s emergency request to freeze nearly $2 billion in foreign aid as part of his efforts to slash government spending.

The court’s brief order was unsigned, which is typical when the justices act on emergency applications. It said only that the trial judge, who had ordered the government to resume payments, “should clarify what obligations the government must fulfill.”

But the ruling represented one of the court’s first moves in response to the flurry of litigation filed in response to Mr. Trump’s efforts to dramatically reshape government. The vote was 5 to 4, with Chief Justice John G. Roberts Jr. and Justice Amy Coney Barrett joining the three liberal members to form a majority.

Although the language of the order was mild, tentative and not a little confusing, its bottom line was that a bare majority of the court ruled against Mr. Trump on one of his signature projects. The president’s many programs and plans, the order suggested, will face close scrutiny from a deeply divided court.

That, in turn, is likely to give rise to major rulings testing and perhaps recalibrating the separation of powers required by the Constitution.

Justice Samuel A. Alito Jr., writing for the four dissenting justices, said the majority had gone profoundly astray.

“Does a single district-court judge who likely lacks jurisdiction have the unchecked power to compel the government of the United States to pay out (and probably lose forever) two billion taxpayer dollars? “ he asked. “The answer to that question should be an emphatic ‘No,’ but a majority of this court apparently thinks otherwise. I am stunned.”..

Immunity Ruling Escalates Long Rise of Presidential Power

The Supreme Court’s decision to bestow presidents with immunity from prosecution over official actions is an extraordinary expansion of executive power that will reverberate long after Donald J. Trump is gone.

Beyond its immediate implications for the election subversion case against Mr. Trump and the prospect that he may feel less constrained by law if he returns to power, the ruling also adds to the nearly relentless rise of presidential power since the mid-20th century.

It had seemed like a constitutional truism in recent years when more than one lower-court opinion addressing novel legal issues raised by Mr. Trump’s norm-breaking behavior observed that presidents are not kings. But suddenly, they do enjoy a kind of monarchical prerogative.

“The relationship between the president and the people he serves has shifted irrevocably,” Justice Sonia Sotomayor wrote in an outraged dissent joined by the court’s other two liberals. “In every use of official power, the president is now a king above the law.”...

SCOTUS Rules in Favor of Constitutional Rights - Gun Grabbers Gasp in Horror

The ruling was quite simple and I believe, correct. Six states place an arbitrary requirement on citizens to prove they are special in some way and thus entitled to constitutional rights that EVERYONE should have access to. The Supreme Court said that is not constitutional and they are correct. Now watch the gun grabber freak out.

The Class Aspect of the Leaked Alito SCOTUS Opinion

The ruling does not ban all abortions even in red states. It tosses it down to the states and still preserves access to 1st trimester abortions. However there is an unmistakable class aspect to this which must be addressed.
