Cuba files declaration to join S Africa's genocide case against Israel at UN's top court

The United Nations' top court says Cuba has officially declared its intention to join South Africa’s case against Israel at the tribunal over the regime's genocide against Palestinians in the Gaza Strip. 

In a statement released on Monday, the International Court of Justice (ICJ) announced that Cuba had filed a declaration of intervention in the proceedings against Israel for Genocide Convention violations under Article 63 of the Statute of The Hague-based court.

“Cuba, invoking Article 63 of the Statute of the Court, filed in the Registry of the Court a declaration of intervention in the case concerning Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip,” it said...

South Africa vs Israel: 14 other countries intend to join the ICJ Israeli Genocide case

Fourteen countries have announced their intention to intervene in the context of South Africa’s complaint, which accuses Israel of “genocide” in the Gaza Strip, before the International Court of Justice (ICJ).

The interveners do not formally join a party or a complaint, but simply present their position on the law (and, in some cases, the facts) without formally taking sides.

The latest to do so is Bolivia on 9 October, following Chile and Maldives. Spain has been in June the third European country to make this announcement after Belgium and Ireland. South Africa filed its complaint on 29 December, 2023, with the ICJ, the United Nations court responsible for resolving disputes between states. Pretoria accuses Israel of violating the Convention on the Prevention and Punishment of the Crime of Genocide in its military assault on Gaza.

The offensive has destroyed large parts of the Palestinian enclave, killed more than 43,000 civilians, and led to massive population displacements. The lack of access to international humanitarian aid is also causing famine to threaten Gaza, according to UN reports. On 24 May, the Court ordered Israel to “immediately cease its military offensive” in the city of Rafah, in southern Gaza. So far, Israel has not complied with this decision...

South Africa submits 750 pages of evidence in genocide case against Israel

South Africa's legal team on 28 October submitted hundreds of documents to the International Court of Justice (ICJ) offering "undeniable evidence" of acts of genocide committed in Gaza by the Israeli army and statements by authorities that carry genocidal intent.

"The evidence will show that undergirding Israel’s genocidal acts is the special intent to commit genocide, a failure by Israel to prevent incitement to genocide, to prevent genocide itself, and its failure to punish those inciting and committing acts of genocide," a statement from Pretoria says.

"South Africa’s Memorial is a reminder to the global community to remember the people of Palestine, to stand in solidarity with them, and to stop the catastrophe. The devastation and suffering has been possible only because despite the ICJ and numerous UN bodies’ actions and interventions, Israel has failed to comply with its international obligations,” the statement added.

Officials say that the submission, also called a memorial, is presented in more than 750 pages of text, in addition to over 4,000 pages of annexes.

Speaking to Al Jazeera, officials said they are confident that the hundreds of pages of evidence are “more than enough” to sustain their case. “The problem we have is that we have too much evidence,” Ambassador Vusimuzi Madonsela, South Africa’s representative to The Hague, told the Qatari news organization.

Some of the evidence submitted includes public statements made last week by senior members of the Israeli government at a conference named "Preparing to Settle in Gaza," which was organized by the extremist Nachala Settlement Movement and promoted by Israel's ruling Likud party...

South Africa to submit evidence against Israel at UN court

South Africa says it plans to file a memorial with the International Court of Justice (ICJ) next month to provide evidence that Israel is committing genocide against Palestinians in its conflict with Hamas in Gaza.

President Cyril Ramaphosa’s office announced the move on Tuesday, vowing that a lawsuit it initiated against the Israeli government late last year will continue until the top court issues its ruling.

Africa’s most advanced economy filed a case with The Hague-based ICJ back in December, alleging that Israel’s offensive in Gaza following a surprise attack by Hamas on the Jewish state more than 11 months ago is “genocidal in character.” Israel declared war on Hamas following a series of raids by the Gaza-based militant group last October 7, which resulted in the deaths of 1,200 Israelis. Since then, Israeli military operations have resulted in nearly 41,000 Palestinian deaths and 95,000 injuries, turning much of Gaza into rubble and rendering it uninhabitable...

Harsh Israeli rhetoric against Palestinians becomes central to South Africa’s genocide case

Fighting “human animals.” Making Gaza a “slaughterhouse.” “Erasing the Gaza Strip from the face of the earth.”

Such inflammatory rhetoric is a key component of South Africa’s case accusing Israel of genocide at the U.N. world court, a charge that Israel denies. South Africa says the language — in comments by Israeli leaders, soldiers and entertainers about Palestinians in Gaza since Hamas’ Oct. 7 attack sparked war — is proof of Israel’s intent to commit genocide.

Israeli leaders have downplayed the comments, and some in Israel say they’re a result of the trauma from Hamas’ attack.

Rights groups and activists say they’re an inevitable byproduct of Israel’s decades-old, open-ended rule over the Palestinians and that they’ve intensified during the war. They say such language has been left unchecked, inciting violence and dehumanizing Palestinians...

UN expert: I received threats and asked not to disclose info on Israel’s genocide

A United Nations human rights expert says she has received threats throughout her mandate of compiling a report about Israel’s genocide in the besieged Gaza Strip.

Francesca Albanese, the Special Rapporteur on the human rights situation in the occupied West Bank and Gaza, said on Wednesday that she had been threatened during the time she was preparing a report on Israel’s acts of genocide in Gaza.

Her report, titled “Anatomy of a Genocide”, was submitted to the UN Human Rights Council on Tuesday. Israel said it “utterly rejects” the report.

When asked whether she received threats during her mandate, Albanese said, “Yes, I do receive threats. Nothing that so far I considered needing extra precautions. Pressure? Yes, and it doesn't change either my commitment or the results of my work.”  

The UN expert, who found Israel committed genocide, did not elaborate on the nature of the threats, nor did she say who had issued them.

“It’s been a difficult time,” Albanese said. “I've always been attacked since the very beginning of my mandate.”

Hamas says to commit to potential ICJ ceasefire ruling if Israel complies

Hamas says it will commit to a potential International Court of Justice (ICJ) ruling mandating a ceasefire in the Gaza Strip, which is enduring a genocidal Israeli war if the Israeli regime adheres to such a verdict too.

The Palestinian resistance movement made the remarks in a statement on Thursday, a day before the court is expected to hand down the ruling in a case lodged against it by South Africa late last month.

 Hamas "is following with great interest the deliberations of the International Court of Justice following the request submitted by South Africa to the court to stop the genocide against our people, especially in Gaza," the statement said...

Israel pays Google to manipulate search results on ICJ genocide case

The Israeli government, which is currently in panic mode, is paying U.S.-based search engine Google to manipulate search results by prioritizing their websites to spread their propaganda, as the country stands trial at the International Court of Justice (ICJ) for committing genocide against Palestinians in Gaza, following South Africa’s initiative.

An ad saying South Africa’s claim is “meaningless” appears at the top of the page when a search using the keywords “icj israel case” is made on Jan. 13 on Google from a browser without an ad-blocker.

When the same search using the same keywords is made on a different browser, another ad saying “SA's case against israel - Stand with Us” pops up at the top of the page, with a URL directing the reader to an Israeli government website.

A brief scroll shows video results from YouTube, saying “Israel accuses South Africa of distorting the truth in ICJ” and “Germany weighs in on South Africa's 'genocide' case against Israel at ICJ.”

The same search made on a browser with an ad-blocker does not show Israel’s ads but puts the videos mentioned above at the top of the search results.

Netanyahu defies the International Court of Justice – “Nobody will stop us”

The South African legal team argued its case against Israel’s genocide in Gaza at the International Court of Justice (ICJ) in The Hague last Thursday. It was a breathtaking session of over three hours, with several exquisite, morally astute speeches, like that of Irish barrister Blinne Ní Ghrálaigh – I was awestruck at the detail and the overview. These speeches must be preserved for posterity as some of the most important in history. Their summation rang like a bell meant to shake the entire world, such as when Ní Ghrálaigh intoned, “The world should be absolutely outraged… There is no safe space in Gaza and the world should be ashamed”. 

But Israel’s Prime Minister, Benjamin Netanyahu, is not ashamed. If he is outraged at anything, it is about the “hypocritical onslaught at The Hague against the state of the Jews.” 

On Saturday, in a nine-minute live speech (in Hebrew) on Israeli Channel 14, Netanyahu once again evoked the “war of the sons of light against the sons of darkness,” the same imagery that he used back in October. He also directly defied the ICJ: “Nobody will stop us – not The Hague, not the axis of evil and not anybody else.”

It requires sheer gall to refer like this to the International Court of Justice, the highest legal authority of the UN, which represents the highest international consensus on international law. To suggest that its rulings will have no consequence is blatantly offensive. In addition, Netanyahu also lied in his speech, claiming that German Chancellor Olaf Scholz called Hamas the “new Nazis” when in fact it was Netanyahu himself who said that

But Netanyahu doesn’t care, not about the truth nor about tarnishing the ICJ. He was speaking in Hebrew to his crowd. And while his scandalous dismissal of the ICJ made headlines, Netanyahu’s speech included other chilling warnings that Israel has no plans to relent in its genocidal attack..

What to Know About South Africa’s Genocide Case Against Israel

On Jan. 11, South Africa and Israel will take the stand before the International Court of Justice (ICJ) in a case that could shape the ongoing Israel-Hamas war. 

Oral proceedings will take place on Thursday and Friday in the Netherlands, after South Africa filed a case against Israel in late December for its “genocidal acts” against Palestinians in Gaza. The suit was filed to the ICJ—the main judicial body of the United Nations which settles international disputes among member states and answers requests for advisory opinion on legal questions.

More than 22,000 Palestinians have been killed since Hamas attacked Israel on Oct. 7 and killed 1,200 people and kidnapped some 200 others. The Gaza Strip has experienced a shortage of resources since, with hospitals and churches subject to airstrikes, and limited international aid coming into the enclave.  

The court, on Thursday, will not decide whether Israel is committing genocide, but instead will assess whether South Africa’s case is strong enough to issue provisional measures that would “protect against further, severe and irreparable harm” to Palestinians and “‘to ensure Israel’s compliance with its obligations under the Genocide Convention not to engage in genocide, and to prevent and to punish genocide,’” the application against Israel says...

A quick guide to South Africa’s ICJ case against Israel

The two-day public hearing in South Africa’s genocide case against Israel at the International Court of Justice (ICJ) begins on Thursday. The South African government brought the case against Israel on December 29, accusing it of “genocidal acts” in its assaults on Gaza.

Palestinians and pro-Palestine campaigners around the world are hoping the ICJ might halt Israel’s devastating military campaign in Gaza, which has seen more than 23,000 people killed – nearly 10,000 of them children.

The ICJ, also called the World Court, is the highest United Nations legal body that can adjudicate on issues between member states. It is separate from the International Criminal Court (ICC), which tries individuals in criminal cases.

The ICJ comprises 15 judges appointed for nine-year terms through elections at the UN General Assembly (UNGA) and the Security Council (UNSC). The court’s rulings are binding and cannot be appealed by member states, but it depends on the UNSC to enforce the decisions.

 South Africa has accused Israel of committing the crime of genocide in Gaza in violation of the 1948 Genocide Convention, which both countries are party to.

The killing of Palestinians in Gaza in large numbers, especially children; destruction of their homes; their expulsion and displacement; blockade on food, water and medical assistance to the strip; the imposition of measures preventing Palestinian births by destroying essential health services crucial for the survival of pregnant women and babies, are all listed as genocidal actions in the suit...

US 'doesn't see' acts of genocide committed by Israel in Gaza

The U.S. is not seeing any acts that constitute genocide against Palestinians in Gaza, a State Department spokesperson said Wednesday, criticizing South Africa's decision to file a genocide case against Israel for its crimes since Oct. 7.

"We don't think it's productive," State Department spokesperson Matthew Miller told reporters.

"Genocide is, of course, a heinous atrocity, one of the most heinous atrocities that any individual can commit," Miller said, adding that those are allegations that "should not made lightly."

However, Miller said the U.S. is "not seeing any acts that constitute genocide."

Asked if the U.S. sees any acts of war crimes, Miller said: "We continue to collect information and gather it as we always do, but I don't have an assessment to offer."

The White House, for its part, said it found the submission "meritless, counterproductive and completely without any basis in fact whatsoever."...

Top UN court to consider genocide case against Israel over Gaza war next week

Judges at the International Court of Justice (ICJ) in The Hague will hear a case on Israel’s “genocidal” acts in the besieged Gaza Strip next week, as a horrible nightmare of bloodshed in the Palestinian territory is unfolding due to the occupying regime’s incessant bombing.

South Africa, in an 84-page suit filed against Israel at the ICJ on December 29, asked the top court to urgently declare that the Tel Aviv regime has breached its responsibilities under international law since October 7, when it launched an ongoing war on the densely-populated coastal sliver.

Pretoria detailed evidence of brutality being perpetrated in Gaza, making South African the first country to file a lawsuit against Israel at the United Nations’ top court.
